Smart contracts
A smart contract is a computer program consisting of predefined instructions specified in digital form. This smart contract is stored on a blockchain (e.g., Ethereum), making it tamper-proof.
The smart contract self-executes and is governed only by its computer code (“if X, then Y, if Y, then Z, etc.”) unlike a traditional contract which is governed by a legal framework that necessarily integrates the various legal issues and notions (e.g. the question of “good faith” or “nullity of the contract”, etc.).
A smart contract is therefore not necessarily a smart legal contract. The smart contract is an addition to the traditional contract, whose execution it ensures.
